These terms and conditions apply to the DocEnhance: PDF Scanner Editor app for mobile devices, together with any related services operated by JAM Technologies (collectively, the "Application"). JAM Technologies is hereby referred to as the "Service Provider".

By downloading, installing, or using the Application, you agree to be bound by these Terms and Conditions. You should read them carefully before using the Application.

1. License to Use the Application

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal or internal business purposes. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as and only to the extent that such activity is expressly permitted by applicable law.

2. Intellectual Property

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding (the "IP"). Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Application.

Unauthorized copying, modification of the Application, any part of the Application, or the Service Provider's trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted.

3. User Eligibility & Termination

By accessing and using this Application, you represent that you are legally permitted to use it in your jurisdiction. You must be at least 18 years of age (or the age of digital consent in your jurisdiction) to use the Application. If you are below 18, a parent or legal guardian must review and accept these Terms on your behalf.

The Service Provider may suspend or terminate your access immediately without notice if you violate applicable law, infringe intellectual property rights, or engage in activity that could cause harm to other users or the Service Provider. Upon termination, your right to use the Application will end and you must delete all copies from your devices.

4. User-Generated Content and Acceptable Use

If this Application allows users to post, share, or upload content, you agree not to post content that:

Is illegal or violates third-party intellectual property rights (copyright, trademark, patents)
Is abusive, threatening, harassing, defamatory, or hate speech
Contains discrimination or incitement to violence or illegal activity
Is spam, phishing, or contains malware
Violates the privacy or personal data rights of others
Is misleading, false, or deceptive
Contains explicit violence or sexual content (unless age-gated appropriately)

The Service Provider reserves the right to moderate, filter, remove, or disable access to content that violates these guidelines and suspend or terminate accounts of violating users.

If you believe content violates these Terms, infringes your rights, or is unlawful, you may report it to the Service Provider at jam.technologies.apps@gmail.com.

5. App Usage, Device Integrity, and Third-Party Services

The Application stores and processes personal data that you have provided in order to deliver the Service. It is your responsibility to maintain the security of your device and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device, which could expose your device to malware, compromise security features, and cause the Application to malfunction.

The Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the third-party service providers used:

Some functions of the Application require an active internet connection (Wi-Fi or cellular). The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of network access or exhausted data allowance. You remain responsible for any carrier charges (including data roaming fees).

6. Disclaimer of Warranties ("AS IS" and "AS AVAILABLE")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION, ITS FEATURES, AND ALL ASSOCIATED SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

THE SERVICE PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WITHOUT LIMITING THE FOREGOING, THE SERVICE PROVIDER DOES NOT WARRANT THAT:

(A) THE APPLICATION WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
(B) THE OPERATION OF THE APPLICATION WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, OR FREE OF BUGS, DEFECTS, GLITCHES, OR ERRORS;
(C) ANY DEFECTS OR ERRORS IN THE APPLICATION WILL BE CORRECTED;
(D) THE APPLICATION OR ANY PROCESSED FILES WILL BE COMPATIBLE WITH ALL DEVICES, OPERATING SYSTEMS, OR THIRD-PARTY SOFTWARE; OR
(E) NO DATA, DOCUMENT, OR CONTENT WILL BE LOST, CORRUPTED, ALTERED, OR DAMAGED DURING SCANNING, EDITING, CONVERSION, COMPRESSION, PROCESSING, OR STORAGE.

7. Software Functionality, AI, and Tool Accuracy Disclaimer

The Application provides various tools for document processing, including but not limited to camera capture, edge detection, perspective correction, cropping, color and enhancement filters, PDF conversion, merging, splitting, compression, Optical Character Recognition (OCR), and other Artificial Intelligence (AI) or machine-learning-driven features.

You acknowledge and agree that:

Inherent Inaccuracy & Error Potential: Automated tools, algorithms, and AI features are provided solely for your convenience and assistance. They may produce results that are inaccurate, incomplete, corrupted, distorted, misaligned, or that misinterpret or misread original text, numbers, formatting, or visual elements.
AI Outputs & Hallucinations: Any AI-generated text, transcriptions, summaries, translations, or data extractions may contain errors, omissions, or fabricated information ("hallucinations").
User Verification Duty: You are solely and exclusively responsible for reviewing, verifying, and confirming the accuracy, completeness, and suitability of any processed document, exported PDF, converted file, or OCR-extracted text before relying upon it, sharing it, sending it, or utilizing it for any purpose.
No Professional, Legal, or Official Certification: The Application is a productivity utility tool and does not provide legal, financial, accounting, medical, tax, compliance, or professional advice. Processed documents do not constitute certified, notarized, or officially authenticated records unless independently certified through authorized legal or governmental channels.
Reliance at Your Own Risk: The Service Provider shall not be held liable for any damages, losses, fines, missed deadlines, legal disputes, financial loss, or harm arising directly or indirectly from your reliance on inaccurate or defective output generated by any tool or feature of the Application.

8. Data Backup, Local Storage, and App Updates

The Application is a local processing utility and is not intended to serve as a permanent storage, cloud backup, or archiving solution. You acknowledge and agree that:

Local Data & User Assets: Any data, files, or assets stored or created locally within the Application — including but not limited to scanned documents, PDF files, saved signatures, drawings, annotations, custom stamps, tags, presets, drafts, and scan history — are stored exclusively on your device's local storage or app data directory.
App Updates and Migrations: The Service Provider continuously improves and updates the Application. Future updates, software patches, architectural changes, database migrations, or feature refactoring may alter, reset, or inadvertently delete locally stored data, preferences, or saved assets (such as saved signatures or draft scans). The Service Provider does not guarantee that locally saved data or configurations will remain intact or backward-compatible across updates.
User Responsibility to Export and Backup: You are solely and exclusively responsible for exporting your documents and maintaining independent, secure, and regular external backups of any critical files, documents, or data.
No Liability for Data Loss: Under no circumstances shall the Service Provider be liable for any loss, corruption, deletion, destruction, or alteration of any document, image, signature, or data stored on or processed through your device, whether resulting from application updates, database migrations, operating system updates, hardware failures, app crashes, bugs, or user error.

9. Limitation of Liability

Nothing in these Terms shall limit any rights you have under applicable consumer protection laws that cannot be lawfully excluded.

To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, document corruption, or business interruption, even if advised of the possibility of such damages.

However, the Service Provider retains full liability for:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any other liability that cannot be excluded or limited under applicable law

To the fullest extent permitted by law, the total liability of the Service Provider for any claim shall not exceed the amount paid by you to the Service Provider for the Application in the 12 months preceding the claim, or the minimum amount that must be paid under applicable law, whichever is greater. If the Application is provided free of charge, the Service Provider's liability is limited to the minimum amount permitted by applicable law.

10. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or directly related to your breach of these Terms, your misuse of the Application, or content you submit or process in violation of these Terms.

11. Digital Services Act (DSA) Compliance (EU Users)

If the Application qualifies as an intermediary service under the Digital Services Act (Regulation (EU) 2022/2065, "DSA"), the following provisions apply:

Point of Contact: EU authorities and users may contact the Service Provider directly at jam.technologies.apps@gmail.com.
Content Moderation & Statement of Reasons: If access or content is restricted, a clear statement of reasons will be provided in accordance with Article 17 of the DSA.
Notice and Action: Notices of illegal content can be submitted to jam.technologies.apps@gmail.com and will be handled diligently in accordance with Article 16 of the DSA.
Dispute Settlement: Users may access certified out-of-court dispute settlement bodies under Article 21 of the DSA without affecting their right to judicial remedies.

12. Governing Law, Severability, and Changes

Governing Law: These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except to the extent mandatory consumer protection laws provide otherwise.
Severability: If any provision of these Terms is held invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and remaining provisions shall remain in full force and effect.
Changes: The Service Provider may update these Terms periodically. Continued use of the Application after updates constitutes acceptance of the modified Terms.
